Though many people think that normal people who are in love don’t need prenups, prenuptial agreements can cover a great deal of every day stuff.  A prenuptial agreement with social media clauses can help you prevent your partner from engaging in activities which may lead to fights and/or embarrassment.  You can have a prenuptial agreement which requires your partner to consult you before posting certain types of pictures.  You can have an agreement which forbids your partner from posting certain types of pictures of your children on public sites.  You can even add non disparagement clauses to ensure that your spouse does not post anything negative about you.  You can create penalties with your partner and put them into your prenuptial agreement.

 

2) IF YOU GET DIVORCED, YOU CAN LOSE YOUR ACCOUNT IN A DIVORCE!

 

People think about divorces and they think about children and about property.  No one says, hey…anything that your have in a marriage has to be split, and then thinks about their interests in online accounts like Facebook.  However, the truth is, when you go to get a divorce, your Facebook profile and account can very well be the biggest part of your divorce.  In fact, a recent study suggests that Facebook users are more likely to divorce!  While TIME MAGAZINE points out that researchers believe there is a connection between Facebook and Divorce, they point out no one knows the exact cause of that connection.  Either way, your Facebook account can be evidence in your divorce.  Even worse, while splitting your assets, your partner might state that the account has been commingled into the marriage or was started during the marriage and as a result, may be marital property.  He or she may even end up with the account.  A prenuptial agreement can state that the parties clearly don’t wish for such a result to happen.

 

3) A SOCIAL MEDIA PRENUPTIAL AGREEMENT CAN LEAVE NO DOUBT THAT YOU WANT TO KEEP YOUR FACEBOOK PAGE/ACCOUNT PRIVATE!

While the law says that anything acquired during a marriage may be marital property and have to be split in the event of a divorce, you can, with a prenuptial agreement, put clauses into effect which clearly state that both parties agree before the marriage that the Facebook Accounts of each party are to be separate property and are not intended to be commingled into the marriage.  Which years ago, prenuptial agreements might have been used more for money and assets, today’s changing environment has made getting a prenuptial agreement a good idea for anyone who is using the internet and social media sites!

Also things created during a marriage can be joint/marital property.  This includes pictures taken during the marriage.  If you take pictures during your marriage, they are joint/marital property and if you get divorced, they can be a part of the the fight.  If you put those pictures on facebook, a court could rule that you commingled marital property into your seperate property and made it marital property.  This could mean your Facebook account and interest in the account could be considered marital/joint property and you could lose it in a divorce!  If you are horrified by that result, you should consider a prenuptial agreement and/or a prenuptial agreement with social media clauses!
